- Prohibition doesn't work

- Sports gambling is actually winnable longterm for some people (unlike lottery, slots, most casino games)

- If sports gambling was legal there would much less fixes due to the fact all wagers would be closely monitored.

- In a free country, the government doesn't have the authority to tell you whether or not you can wager on a sporting event in the privacy of your home.

Just a few talking points

Argue that millions of people are doing it on the internet in the US so why not just legalize it because (1) it is impossible for the government to go after everyone gambling online because there are so many people doing it and (2) by legalizing it society can reap the benefits. This is where you have to determine what the benefits are:

Say hey kid is one track - especially with the aspect of rights as citizens. Is it a fundamental right to be able to spend your money as you please? If not, then should it? Argue that people as US citizens should have a right to freely spend their own money. In other words, legalization promotes individual freedoms which are afforded to all US citizens in the US Consitution.

Moreover, the government can tax gambling proceeds. The government taxes damn near all gross income including gambling proceeds - even if they are illegally made you still have a duty to claim them on your income tax forms. Also, other taxes and fees can be asserted against casinos and books. Now, think of the ways a gambling tax can be spent by the government to help society. Taxation of gambling proceeds can help fund education, welfare benefits, low income housing, etc.

Just a few ideas

A bit of information that maybe helpful to know is that online gambling is illegal in the United States, unless you are gambling at a location that has legalized gambling. Where the bet is placed makes the determination of where the transaction takes place ie. if I place a bet in Kansas, and gambling is illegal in Kansas, then I just made an illegal wager.

What is important to know is the government does not go after every person gambling online because it would be a never-ending and costly ordeal. There are just too many people gambling online in the US. Think of everyone playing holdem, sports betting, horses, etc. There aren't enough G-Men out there to go nab everyone. Plus, the courts and jails would be overflowing. Instead, the government focuses on the people who run the gambling websites. If you run a gambling website in the US, they will get your ass. If you are from the US, and move to an island to start up an online wagering website, better make sure there are no extradition laws. Also, better make sure to never show your ass back in the US again because the FBI knows who you are and will be waiting.

Not many people actually know the law, and thought I would point it out as maybe helpful for your paper

Weird. My local actually has a tax stamp and as long as he pays taxes on his winnings they leave him alone.

Like I said, depends on your location. The only locations inside the US that I'm aware of is Nevada and New Jersey...not certain about Detroit as far as online gaming goes (not counting Indian reservations as they are have a decent amount of sovereighty). I also have never heard of a tax stamp for gambling inside the US; however, it's been about 3 years since I've kept up with state and federal gaming laws

it is not illegal to gamble online in the U.S......

I'm not sure where you got this information, but it is incorrect. I've seen other posters on here, in the past, make the same statement, but it is false (in general).

I recevied a Blue Book Award in Gaming Law while in Law School. Particularly, writing on the subject of online gaming in the US. I also took a class in American Indian Law, which regards reservations and includes gaming on reservations.

I wish we would just get to the point where the pointspread is already part of the scoreboard before the team takes the field or have two scoreboards. Kinda takes the mystery out of it. What a great motivator for the underdog coming out on the field.

There are many states where betting is legal, so these states are making lot of tax revenue from the betting business. By this these states are putting those money in the development of the state.
